Terms for Hotspot Owners

Plain-English summary: If you list, claim, or upgrade a hotspot on GayOut, you agree to these owner-specific rules in addition to our general Terms of Service. You confirm you have the right to represent the venue, that all information is accurate, and that you'll keep it up to date. Promoted and Premium plans renew automatically and offer a 14-day money-back guarantee.
These Terms for Hotspot Owners ("Owner Terms") apply in addition to our general Terms of Service if you (the "Owner") submit, claim, manage, or upgrade a hotspot listing on gayout.com (the "Service"). In case of conflict between these Owner Terms and the general Terms of Service, the Owner Terms prevail with respect to your hotspot.

1. Owner authority & representations
By submitting or claiming a hotspot, you represent and warrant that:
- You are the lawful owner, manager, employee, or duly authorised representative of the venue, with full power and authority to bind it.
- You have all necessary rights, consents, and licences to upload and display the photos, descriptions, logos, and any other materials you submit.
- The contact details (phone, email, website) you provide are accurate and current.
- The venue exists, is open to the public (or operates lawfully as a private club where applicable), and complies with all applicable laws, including those governing alcohol service, food safety, accessibility, public health, fire safety, and zoning.
- You are not subject to any prohibition that would prevent listing on GayOut, including any economic sanctions, court injunction, or regulatory order.
If we discover that any of these representations is false, we may suspend, remove, or refuse the listing without notice and without refund.
2. Listing accuracy & updates
You agree to keep your listing accurate and up to date, including:
- Opening hours and seasonal closures.
- Address, phone, website, and social-media links.
- Age restrictions or entry requirements (e.g., 18+ / 21+).
- Any change of ownership, closure, or relocation.
You can edit your listing via the magic-link sign-in. We may also fact-check or augment your listing using publicly available data (Google Places, TripAdvisor, official websites). If you disagree with any auto-imported data, you can override it in the management dashboard.
3. Content licence to GayOut
By submitting hotspot content, you grant GayOut a worldwide, non-exclusive, royalty-free, transferable, sub-licensable, perpetual, irrevocable licence to host, store, reproduce, modify (for formatting and display only), translate (including via AI), distribute, publicly perform, publicly display, and create derivative works of your content, solely for the purpose of operating, promoting, and improving the Service. This licence survives cancellation of your subscription in respect of content already published. You can request deletion of specific content via the dashboard or by emailing support@gayout.com.
4. Claiming an existing listing
If a listing for your venue already exists, you may submit a "claim" with proof of authority. We may verify by:
- Cross-checking the email domain against the venue's official website.
- Confirming the phone number matches public records.
- Requesting documentary evidence (business licence, utility bill, tax certificate).
- Calling the venue's listed phone number.
Approval is at our sole discretion. False claims may result in permanent suspension and possible legal action.
5. Tiers — what's included
Free
- Listing in directory and on world map.
- Up to 5 photos.
- Description, tags, opening hours, age restrictions.
- Magic-link editing.
- Phone and website shown as plain text only (not clickable).
- Listing approval within 7 days.
⭐ Promoted ($29 / year)
- Everything in Free, plus:
- Tap-to-call phone number.
- Clickable website link.
- Social-media buttons (WhatsApp, Telegram, Instagram, Facebook).
- Listed before Free hotspots in the same city/category.
- "⭐ Promoted" badge on every listing.
- Listing approval within 24 hours.
💎 Premium ($99 / year)
- Everything in Promoted, plus:
- Featured on the GayOut homepage.
- Top 3 placement in the city's listings.
- Large hero cover image.
- YouTube video embed.
- Publish your own events.
- Analytics dashboard.
- Priority support (within 48 hours).
- "💎 Verified Premium" badge.
Feature changes: we may add, modify, or remove features within any tier from time to time. Material reductions to a paid tier give you a pro-rated refund or an equivalent replacement at our discretion.
6. Subscriptions, billing & refunds
Promoted and Premium are paid through PayPal subscriptions. By subscribing you authorise PayPal to charge your nominated payment method automatically each year on the renewal date until you cancel.
- Currency: all prices are in US dollars unless stated otherwise.
- Taxes: prices exclude VAT, sales tax, GST, or similar; you are responsible for any taxes that apply in your jurisdiction.
- 14-day money-back guarantee: for the first 14 days of each new subscription, email support@gayout.com for a full refund. After 14 days, refunds are at our sole discretion.
- No pro-rated refunds for partial periods after the 14-day window.
- Failed payments: if PayPal cannot collect, your hotspot may be suspended after a grace period and downgraded to Free. We will email you before downgrading.
- Chargebacks: initiating a chargeback without first contacting us in good faith is a material breach and may result in permanent removal of your listing.
7. Automatic renewal & cancellation
Subscriptions automatically renew at the same price (subject to Section 5 above) for additional one-year terms unless cancelled before the renewal date. To cancel:
- Open PayPal > Manage automatic payments.
- Find the GayOut subscription.
- Click "Cancel".
Cancellation takes effect at the end of the current billing period; you keep paid features until then. After expiration, your hotspot reverts to the Free tier — your photos, descriptions, and reviews remain on the Service.
8. Suspension & removal of listings
We may suspend or permanently remove your listing, with or without notice, if we have reasonable grounds to believe that:
- The listing is fraudulent, duplicates, or impersonates another business.
- The information is materially inaccurate and you have not corrected it within 14 days of our request.
- The venue is closed, no longer operating, or operating unlawfully.
- The Owner has breached these Owner Terms or our general Terms of Service.
- The Owner is the subject of a court order, enforcement action, or sanctions list.
- We receive credible reports of unsafe, discriminatory, or illegal practices at the venue.
If a listing is removed for breach, no refund is due. If it is removed for our convenience without breach, we will issue a pro-rated refund.
9. Owner conduct & prohibited content
You must not:
- Submit fake reviews or solicit reviews from people who have not visited the venue.
- Offer or imply incentives in exchange for positive reviews ("review-for-discount").
- Post content that promotes hate, discrimination, sex with minors, illegal drugs, weapons, escort services not permitted by local law, or any content that violates the rights of LGBTQ+ persons.
- Use the Service to harass other Owners, reviewers, or GayOut staff.
- Attempt to manipulate search rankings or gaming any GayOut feature.
- Use the GayOut name, logo, or trade dress in advertising without our prior written consent (except for fair, factual statements like "Find us on GayOut").
10. Reviews of your hotspot
Reviews come from members of the LGBTQ+ travel community and are protected expressions of opinion. We do not remove reviews simply because the Owner disagrees with them. Reviews may be removed only when they violate our review policy (e.g., personal attacks, profanity, off-topic content, conflicts of interest) or applicable law.
If you believe a review is unlawful or violates our policy, flag it via the venue page or email support@gayout.com with specifics. Frivolous removal requests may result in restrictions on your account.
11. Local-law compliance
You are solely responsible for ensuring that the operation of your venue, the content of your listing, and any promotions you run comply with all applicable laws — including, where relevant, laws relating to advertising of regulated products (alcohol, tobacco, cannabis), consumer protection, anti-discrimination, accessibility, employment, taxation, and the rights of LGBTQ+ persons in your jurisdiction.
Where local law prohibits the public listing of LGBTQ+ venues, you accept all risk of listing your venue on GayOut. We do not undertake to defend listings against legal action by third parties or governments.
12. No guarantee of traffic, leads, or revenue
13. Limitation of liability for owners
The limitation-of-liability provisions of our general Terms of Service apply to your use of the paid Service. In addition, our aggregate liability to any Owner for any claim arising out of these Owner Terms or your subscription is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim.
14. Indemnification by the Owner
You agree to defend, indemnify, and hold harmless GayOut, its affiliates, and their officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or connected with: (a) the operation of your venue; (b) any incident occurring at your venue or arising from your services; (c) your User Content; (d) your breach of these Owner Terms; or (e) any third-party claim that your listing infringes its rights.
15. Assignment & ownership change
If your venue is sold, transferred, or merged, the new owner must claim the listing and accept these Owner Terms. The previous Owner remains responsible for amounts due before the transfer. We may, at our discretion, transfer subscription benefits to the new Owner upon receipt of satisfactory proof.
16. Disputes & jurisdiction
The dispute-resolution provisions of our general Terms of Service apply, including the obligation to first contact us informally, the binding arbitration in Tel Aviv-Yafo, Israel, and the class-action waiver. Mandatory consumer-protection laws applicable to you continue to apply.
